1. Acceptance of Terms

By accessing or using the RackHour platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

RackHour provides an online marketplace that connects freelance fitness trainers ("Trainers") with gym owners ("Owners") who have available space for training sessions (the "Service"). RackHour acts solely as an intermediary to facilitate these connections and payments.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Immediately notify RackHour if you discover or otherwise suspect any security breaches related to the Service.

4. Booking and Payments

Trainers agree to pay the fees established by Owners for the use of their facilities. RackHour charges a service fee for the use of the platform.

  • All bookings are subject to availability and acceptance by the Owner.
  • Payments are processed securely through our third-party payment processor.
  • Cancellations are subject to the specific cancellation policy selected by the Owner and displayed on the listing.

5. User Conduct

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable law or regulation.
  • Infringing the rights of any third party, including intellectual property rights.
  • Harassing, abusing, or harming another person.
  • Using the Service for any purpose that is fraudulent or malicious.

6. Liability and Insurance

Trainers are required to maintain their own professional liability insurance. Owners are responsible for maintaining premises liability insurance. RackHour is not a party to the agreement between Trainers and Owners and is not liable for any disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to conduct of Trainers or Owners.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.
